The purpose of this Privacy Policy is to inform you of how we collect, store, and use your personal information, and to explain your rights in relation to it.

By using a Source Group website (including www.sourcegroup.co.nz, www.thepropertybuyers.co.nz, www.developmentland.co.nz, websites specific to our property developments, and any other website we may establish or operate from time to time), and/or providing us with your personal information, you acknowledge that we will handle it in accordance with this Privacy Policy.

What Personal Information We Collect (And Why)

We collect the following types of personal information:

  • Website enquiries: name, email address, and phone number (to respond to your enquiry and provide information about our properties and services).
  • Show home / open home visits: name, email address, and phone number (to follow up on your visit and provide further information about our properties).
  • Property purchases: name, email address, phone number, and your solicitor/conveyancer’s contact details (to prepare and manage your Agreement for Sale and Purchase and progress your purchase through to settlement).
  • Website analytics and advertising: IP address, device and browser information, browsing behaviour on our websites, and interactions with our advertisements. We use tools such as the Meta (Facebook) Pixel and Conversions API, which may involve sharing information (including hashed/encrypted versions of your contact details) with Meta to measure and improve the performance of our advertising. See “Overseas Storage and Disclosure” below for more on this.

If you provide us with your contact details through a website enquiry form, you may also be added to our marketing communications, which you can opt out of at any time (see “How We Use Your Information” below).

How We Collect Personal Information

We collect personal information:

  • directly from you, when you fill in a form on one of our websites, sign in at a showhome, enter into an Agreement for Sale and Purchase, or otherwise contact us by phone, email, or in person;
  • automatically, through cookies and similar tracking technologies when you visit our websites or interact with our online advertising;
  • from third parties, such as real estate listing websites through which you may enquire about a property we are advertising, or from a buyer’s representative acting on your behalf (for example, a real estate agent, financial adviser, or solicitor).

How We Use Personal Information

We use personal information to:

  • respond to your enquiries and provide information about our properties and services;
  • follow up with you after a showhome visit or online enquiry;
  • prepare, manage, and progress Agreements for Sale and Purchase through to settlement;
  • liaise with your solicitor, conveyancer, or other representatives where relevant to your purchase;
  • send you marketing communications about our developments, where you have provided your details for this purpose (you can opt out at any time);
  • measure and improve the performance of our website and advertising, including through analytics and tools such as the Meta Pixel and Conversions API;
  • obtain feedback about your experience as our customer;
  • maintain our business records;
  • comply with our legal obligations; and
  • detect, investigate, and prevent fraud or other unlawful activity.

When We Disclose Personal Information

We may disclose personal information to:

  • Meta (Facebook), for advertising and marketing purposes, as described above;
  • solicitors and conveyancers, including yours and ours, in connection with your property purchase;
  • real estate agents and other buyer representatives acting on your behalf;
  • IT and cloud storage providers who help us store and manage information (such as Google Drive);
  • our email marketing platform provider, for sending marketing communications;
  • our employees, contractors, and business partners, for the purposes set out in this Privacy Policy, and for the purposes of those parties providing services to us or performing business functions on our behalf;
  • third parties with whom we have business partner relationships, as shown on www.sourcegroup.co.nz, in connection with the services we provide;
  • anyone else you authorise us to disclose your information to; and
  • as otherwise required or permitted by law.

We only disclose personal information where necessary for these purposes, or where required by law.

Overseas Storage and Disclosure

Some of the third parties we use to store or process personal information (including Meta (Facebook) and Google Drive) may store or process information on servers located outside New Zealand.

Where we disclose personal information to an overseas person or organisation, we take reasonable steps to comply with the Privacy Act 2020 (including Information Privacy Principle 12), such as by ensuring the recipient is subject to privacy safeguards comparable to those under New Zealand law, relying on the recipient’s own compliance with a comparable law (such as major providers like Meta and Google being subject to their own binding privacy frameworks), or otherwise relying on a permitted basis for the disclosure under the Privacy Act.

How We Store and Protect Personal Information

We take reasonable steps to protect personal information from loss, unauthorised access, use, modification, or disclosure. These steps include:

  • restricting access to personal information to those who need it to perform their role;
  • using secure systems and reputable service providers to store and process information;
  • not storing full payment card details; and
  • training our staff on their obligations in handling personal information.

However, no method of storage or transmission over the internet is completely secure, and we cannot guarantee absolute security.

Access and Correction Requests

Under the Privacy Act 2020, you have the right to request access to the personal information we hold about you, and to request that it be corrected if you believe it is inaccurate, incomplete, or out of date.

To make a request, please contact us using the details in “Who We Are and How to Contact Us” above. We may need to verify your identity before providing access to, or correcting, your information. We will respond to your request as soon as reasonably practicable, and in any event within the timeframes required by the Privacy Act 2020.

In some circumstances, we may be entitled to refuse a request for access or correction. If we do, we will explain our reasons for doing so.

How Long We Keep Information

We keep personal information only for as long as necessary to fulfil the purposes for which it was collected, including to meet our legal, accounting, or reporting requirements. For example, records relating to a completed property purchase may need to be retained for a number of years to satisfy tax and legal obligations.

When personal information is no longer needed, we take reasonable steps to securely delete or de-identify it.
